12/7/23 @10am Special Commissioner Meeting – The meeting is about county capital expenditures.  

Public comments is at the end of this meeting. Public comments can be on anything that is not on the agenda. Great time to start voicing opinions about  Resolution 23-62 

In the resolution they (Joe and Jim) use the complaints against Rina Moores office in 2022 as the reason to remove the current Administrator. 

WHEREAS, pursuant to MCA § 7-5-2107, the Board of Cascade County Commissioners may employ

WHEREAS, by declining to previously act pursuant to MCA § 13-1-301(1) to appoint an Election Administrator for Cascade County, the Cascade County Clerk and Recorder served as Cascade County’s Election Administrator during the 2022 election cycle, despite being a candidate named on the ballot; and

WHEREAS, despite multiple repeat requests and an abundance of opportunity to do so, Cascade County’s Election Administrator refused to voluntarily recuse herself from serving as Cascade County’s Election Administrator while seeking re-election as Cascade County’s Clerk and Recorder; and

WHEREAS, by failing to recuse herself from serving as Cascade County’s Election Administrator during her 2022 bid to be re-elected as Clerk and Recorder, the Board of Cascade County Commissioners received multiple complaints, concerns, and criticisms surrounding the perceived lack of transparency and appearance of impropriety of having the Cascade County Clerk and Recorder in charge of all election operations while also appearing as a candidate on the ballot; and

WHEREAS, unlike the requirements under Montana Code Annotated Title 2, Chapter 3, Parts 1 and 2, and MCA §§ 7-5-2122 and 7-5-2125, which require all meetings of the board of county commissioners to be publicly noticed and conducted and receive public comment and participation, there is no such transparency or public participation requirement for actions taken by an independently elected official, such as the Cascade County Clerk and Recorder; and

WHEREAS, appointing an Election Administrator to serve at the direction of the Board of Cascade County Commissioners will place the Election Administrator’s office under the control and direction of the Board of County Commissioners, thereby opening the operations of the election’s office to the same statutory transparency required of acts of the Board of County Commissioners under Montana Code Annotated Title 2, Chapter 3, Parts 1 and 2, and MCA §§ 7-5-2122 and 7-5-2125; and

Corrections/additions in italics:

Cascade County Commissioners of Great Falls Montana today created RESOLUTION 23-62 which strips away the citizens right to vote for their Election Administrator. Cascade County Commissioners Joe Briggs and Jim Larson (in my opinion) colluded with the Great Falls UNI-Party and their leader Pete Fontana and sister Rina Fontana-Moore (the former Election Administrator) the Resolution strips the Elections administrator duties from the 2023 newly elected Clerk and Recorder Sandra Merchant. The commissioners will vote on this RESOLUTION on 12/12/23 at 9:30am  AND IT WILL GO INTO AFFECT IMMEDIATELY IF 2 OF 3 COMMISSIONERS VOTE YES.   The elections office will fall under the supervision of the county commissioners who  will appoint a new election administrator which will be most likely Rina Moore’s former elections supervisor Lynn Derouch (sp).  

Since taking office in 2023, Merchant has cleaned up the county voter roll by removing 12,000 non active voters. She followed the law in her canvass and has been challenge by the local “gang in charge” since starting in office. Tuesday 12/12/23 the citizens of Cascade County will most likely lose their right to vote for their Election Administrator unless something happens. 

We can vote them in, but they can take them out.
